1. Who We Are
SellCarInstant ("we," "us," "our," "the Company") is operated by MOM Digital Marketing, a proprietorship incorporated under the laws of India, having its registered office at E-90, Lal Bagh, Loni, Ghaziabad, UP - 201102, India.
These Terms & Conditions ("Terms") govern your use of the website sellcarinstant.shop ("Site") and the vehicle purchase service offered through it, and constitute an electronic record under the Information Technology Act, 2000 and rules made thereunder. This document does not require any physical or digital signature.
2. Regulatory Status
Buying and selling of used motor vehicles in India is subject to state-level regulation, including registration/trade certificate requirements under the Motor Vehicles Act, 1988 and applicable Central Motor Vehicles Rules, and, where relevant, registration as a used-vehicle dealer with the concerned Regional Transport Office (RTO) or State Transport Authority.
3. What This Service Does
SellCarInstant provides an online tool to request a cash offer for your vehicle. The process is:
You submit information about your vehicle (year, make, model, odometer reading, registration state/RTO, and condition).
We generate a preliminary cash offer based on that information and current market data.
We inspect your vehicle in person or by video call to confirm the details you provided, and verify original documents (Registration Certificate, Insurance, PUC, ID/address proof, and where applicable, No Objection Certificate for loan closure).
If the inspection confirms your information, we finalize the offer, complete the sale agreement, and arrange payment and RTO transfer paperwork.
4. Nature of the Online Offer
The offer you receive online is an estimate, based solely on the information you provide. It is not a binding purchase commitment.
Your final offer is confirmed only after physical or video inspection and document verification. The final offer may be higher or lower than the online estimate if your vehicle's actual condition, odometer reading, accident/salvage history, or document status differs from what was submitted.
Online offers are valid for 7 days from the date issued, unless otherwise stated at the time of quote.
5. No Obligation Until You Accept
Submitting your vehicle information does not obligate you to sell your vehicle to us. You may decline any offer, at any stage, up until you sign a final sale agreement / Form 29 & Form 30 (or applicable transfer forms) and receive payment.
6. Fees
We do not charge listing, inspection, appraisal, towing, or pickup fees to you. Statutory charges (such as RTO transfer fees, if applicable) will be clearly disclosed and are typically borne by [specify: buyer/seller — clarify who pays] before you accept the final offer.
7. Vehicles with an Outstanding Loan (Hypothecation)
If your vehicle has an outstanding loan and hypothecation noted on the Registration Certificate, we can arrange to pay off the remaining loan balance directly to your lender/NBFC as part of the transaction, obtain the hypothecation removal, and pay you the difference. This process, including the payoff amount, hypothecation cancellation timeline, and required documents (loan closure letter, NOC), will be explained to you in writing before you accept the final offer.
8. Documents Required
To complete a sale, you will typically need to provide:
Original Registration Certificate (RC)
Valid insurance and PUC certificate (or their status will be discussed)
Identity and address proof matching the RC
Loan closure NOC / hypothecation cancellation, if applicable
Duly signed transfer forms (Form 29, Form 30) and Form 35 (for hypothecation cancellation), where applicable
We will guide you through the specific document requirements applicable to your state's RTO before finalizing the sale.
9. Title, Ownership, and Representations
You represent that you are the legal, registered owner of the vehicle, or are authorized by the registered owner to sell it, and that the vehicle is free of undisclosed liens, hypothecation, theft record, or ownership/legal disputes except as disclosed to us. Providing false information about ownership, accident history, or title status may render the transaction void and may expose you to liability under applicable law.
10. Payment
Payment is issued at the time of completion of inspection, document verification, and execution of the sale agreement, using the payment method disclosed to you in advance (e.g., NEFT/RTGS/IMPS bank transfer). We do not make cash payments above the threshold prescribed under the Income Tax Act, 1961 (currently ₹2,00,000 per transaction under Section 269ST) and will use banking channels for such amounts.
11. Cancellation
Either party may decline to proceed with the sale at any point before the sale agreement and transfer forms are signed and payment is issued, without penalty.
12. Grievance Redressal
In accordance with the Consumer Protection (E-Commerce) Rules, 2020 and the Information Technology Act, 2000, grievances may be addressed to our Grievance Officer:

We will acknowledge your grievance within 48 hours and resolve it within one month from the date of receipt, as required under applicable rules.
13. Limitation of Liability
To the fullest extent permitted by Indian law, SellCarInstant is not liable for indirect, incidental, or consequential losses arising from use of this Site or the vehicle-purchase process, except where such liability cannot be limited under the Consumer Protection Act, 2019 or other applicable law.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Subject to applicable consumer protection provisions permitting a consumer to approach a forum in their own place of residence, the courts at Delhi shall have exclusive jurisdiction over any disputes arising from these Terms.
